Privacy

We will never sell your personal data or contact information. Your privacy is of utmost importance to us. For more information, see our Privacy Pledge.

Refund, Cancellation or No Show

​

The 20% advanced payment due at the time of booking is non-refundable. Cancellations or amendments of bookings must be received by LuxeAway in writing/per email to be effective. The customer can withdraw from the trip (excluding East Africa trips) at any time prior to 30 days before departure. Return of monies paid to LuxeAway will be refundable for individual cancellations per the cancellation table below, less any non-refundable payments/deposits made by LuxeAway to secure hotel accommodations, meals, show tickets, admission tickets to attractions, transportation, etc. NO REFUNDS, for any reason, will be paid for individual cancellations received 30 days or less from the departure date.

  • 61 or more days before departure 100% refunded, excluding flights, initial 20% deposit and any non-recoverable payments.

  • 60 -31 days prior to departure, 50% refund of the invoiced amount, excluding the non-refundable 20% deposit, any non-recoverable payments and flights. 

  • 30 days or less no refunds.

Cancellations terms for East Africa Trips:

​

  • 75 or more days before departure 75% refunded, excluding flights, initial 25% deposit and any non-recoverable payments.

  • 31-74 days prior to departure, 50% refund of the invoiced amount, excluding the non-refundable 25% deposit, any non-recoverable payments and flights. 

  • 30 days or less no refunds.

If accommodation was paid using hotel rewards points, we cannot guarantee the return of the points value. Regarding Airline tickets and fees, we cannot guarantee refund on any monies paid. If airline tickets and fees were paid using a voucher, we cannot guarantee return of the voucher value.

Welcome to LuxeAway.co. Please read our General Terms and Conditions and travel information carefully as these are the terms of the contract between you and Luxeaway LLC, hereinafter referred to as “LuxeAway”.

​

This Website is provided solely to assist users in connecting travelers with Location Experts, making legitimate reservations or otherwise transacting business with Travel Suppliers and for no other reason. The terms “we”, “us”, “our”, and “LuxeAway” refer to LuxeAway. The term “you” or “customer” refers to the customer visiting or using the Website and/or connecting with a location expert through us on this Website.

This Website is offered to you conditioned upon your acceptance without modification of all the terms, conditions, and notices set forth below (collectively, the “Terms of Use” or “Agreement”). These terms and conditions are valid for all LuxeAway bookings, and are subject to change. The most current terms and conditions at the time of your departure will apply. By using any part of our website or sharing your personal information with us, you are accepting and consenting to the practices described in our Privacy Policy. If you do not agree to the Terms of Use or the Privacy Policy, please do not use or book any reservations through this Website or our Travel Experts.

Use of the Website

​

You warrant that you are at least 18 years of age and possess the legal authority to enter into this agreement and to use the Website in accordance with all Terms of Use herein. If you are using this Website and/or making travel reservations or bookings for another person you agree to inform that person(s) about the Terms & Conditions that apply to the travel reservations and bookings you have made on their behalf, including all rules and restrictions applicable thereto and these Terms of Use. You agree to be financially responsible for all of your use of the Website (as well as for use of your account by others). You are responsible for any bookings and travel reservations made by persons under your direction or control. You also warrant that all information supplied by you or on your behalf, or by members of your household in using the Website is true, current, complete and accurate. Furthermore, you also confirm that the traveler is not an unaccompanied minor. Without limitation, any exploratory, speculative, false, or fraudulent reservation or any reservation in anticipation of demand is prohibited.

Communications​

​

When you complete our trip builder form, you agree to receive timely and professional communications from LuxeAway via text and email. We will use your phone number to provide essential updates and information about your trip. Rest assured, we value your privacy and will never spam you. Our communications are designed to enhance your travel planning experience, and you can opt out at any time if you choose. Your satisfaction and trust are our top priorities.

Booking

​

Your booking is confirmed and a contract between you and LuxeAway will exist when we send you confirmation. Please check your confirmation carefully and report any incorrect or incomplete information to LuxeAway immediately. LuxeAway has no responsibility for any errors in any documentation except where an error is made by us. Images of destinations and accommodations are intended as examples and may differ in detail from reality.

Flights

​

In the event that LuxeAway books your flights, please be aware that LuxeAway holds no responsibility for any schedule changes, delays, cancellations, or missed connections that may occur. These events are beyond our control and are subject to the policies and procedures of the respective airlines. We recommend that travelers regularly check their flight status and stay informed of any potential changes to their travel plans. LuxeAway is committed to providing assistance within our capacity; however, the responsibility for handling any disruptions rests with the airlines and relevant authorities. Any unexpected or additional costs will be invoiced to the customer.

If LuxeAway purchases airline tickets on your behalf, the customer has 24 hours from our notification to either send an ACH / Wire Transfer or provide proof of funds in transit. If neither is provided, your flight will be canceled.

​

Pricing and Payment

​

Following the conclusion of a contract an advance payment amounting to 20% of the travel package price shall become due for payment by the customer to LuxeAway. Please note, we reserve the right to increase the deposit percentage based on certain locations and high-demand times. Payment of the residual balance amount shall become due for payment 60 days prior to LuxeAway commencing the provision of services and for any trips to East Africa (Tanzania, Kenya, Rwanda and Uganda), the residual balance amount shall become due 75 days prior to LuxeAway commencing the provision of services. In relation to bookings which are placed within a term shorter than 60 days prior to travel services commencing the entire travel package price shall be payable immediately upon booking. If the customer fails to pay the advance payment and/or the residual balance in accordance with the agreed payment terms, despite LuxeAway having duly fulfilled its statutory information duties and being ready and able to duly perform the contractual travel package services, and provided moreover, the customer does not hold any legal or contractual right to retain such payments, LuxeAway will submit to the customer a reminder notice defining a period within which the customer is to effect such overdue payments and announcing that, in the event of the customer continuing to fail effecting such payments, LuxeAway will rescind the travel contract and charge to the customer any cancellation fees in accordance with the provisions below.

Any cancellation fees, processing and booking amendment fees, as well as insurance premiums, are due immediately after invoicing by LuxeAway. The travel documents will be sent to the customer in advance of departure after receipt of his final payment at LuxeAway. If the booking is made less than 60 days before departure, the entire travel price is due immediately upon receipt of the written travel confirmation. Payment is only possible with ACH, wire or bank transfer with the exception of trip add-ons under 1,000 USD where credit card payments may be accepted at the discretion of LuxeAway.

Force Majeure

​

LuxeAway will notify you as soon as practicable when it is affected by a Force Majeure. LuxeAway shall not be deemed to be in breach of your Booking or these conditions or otherwise be liable to you, by reason of delay in performance, or by nonperformance of any of its obligations hereunder to the extent that any such delay or non-performance is due to any Force Majeure. If LuxeAway is affected by Force Majeure it shall be entitled to, on its sole discretion, cancel or vary any arrangements or itinerary in relation to your Booking. Payment of any refund by LuxeAway as a result of the non-performance of any of its obligations hereunder shall remain its sole and absolute discretion. It being understood that LuxeAway shall use its reasonable endeavors to reimburse you where possible.

“Force Majeure” means, in relation to LuxeAway, any circumstances beyond its reasonable control (including, but without limitation, war or threat of war, sabotage, civil disturbance, or requisition, acts of God, fire, accident, flood or explosion, pandemic, quarantine, Government intervention, weather conditions or other untoward occurrences).

Special Requests

​

LuxeAway accepts special requests only for the purpose of forwarding the same to the Travel Supplier. Unless explicitly agreed otherwise, LuxeAway shall not be liable for the fulfillment of such special requests. Such requests shall neither constitute any contractual condition nor contractual basis for the facilitating agent or the booking statement of the customer. The customer shall be informed that special requests generally only become part of the Travel Supplier’s contractual obligations subject to the -Travel Supplier having given express confirmation to this effect.

 

Conduct Expected

​

Each customer is expected to act responsibly and adhere to all behavior guidelines established by the Travel Supplier. Additionally, customers shall hereby defend, indemnify, and hold harmless LuxeAway against any, and all third-party claims arising out of any conduct or omission in breach of these terms and conditions or that otherwise create liability for LuxeAway.

 

Changes prior to trip or individual tour (not including flights)

​

1. LuxeAway or Travel Supplier Changes

​

Cancellation or Rescheduling by Travel Supplier or other Third Party: In the event the Travel Supplier or other entity associated with the Travel Supplier chooses to change the departure date, the standard cancellation charges remain effective for the original departure date. Cancellation of a tour without LuxeAway’s consent is subject to standard cancellation charges. Cancellation by LuxeAway: LuxeAway reserves the right to cancel any tour at its sole discretion. In the unlikely event a tour is cancelled by LuxeAway and LuxeAway is unable to reschedule, all funds collected from any participant will be promptly refunded in full. Money is refunded to the original payer.

2. Customer Changes

​

After conclusion of the contract, the customer is entitled to make changes to the travel date, the travel destination, the place of departure, the accommodation, the type of catering, the type of transport or other services (rebooking) up to 30 days before departure - excluding flights, where any the customer will incur any difference in price and any rebooking fees associated with the booking modification. LuxeAway reserves the right to charge a 20% rebooking fee of the entire trip value for any changes to the contract within the window of the time of booking to 30 days from departure. Any resulting travel price differences will be taken into account irrespective of this. In the event of a rebooking, LuxeAway cannot guarantee equal quality of initial booking.  

 

A rebooking fee will not be charged if the rebooking is necessary because LuxeAway has provided no, insufficient or incorrect pre-contractual information to the Passenger; in this case the rebooking is free of charge. Within 30 days or less of departure, there are absolutely no changes to the contract or refunds.

LuxeAway cannot offer changes with regard to the booked time, place of destination or departure, accommodation, the means of transport as well as the place of boarding or disembarking (booking amendments). If a minor booking change (activities or restaurants only), is possible and applied in accordance with the customer’s request, LuxeAway, provided the timelines defined below are duly observed, shall be entitled to charge a booking change fee per person affected by such requested change. Unless specifically agreed otherwise prior to LuxeAway accepting a booking change, the fee for changes shall amount to $200 per affected traveler plus any costs and fees associated with such change. All changes are at the sole discretion of LuxeAway. Any customer request to change travel bookings which are communicated at any time later than 30 days prior to departure, provided such change is possible at all, may only be applied by way of the customer cancelling the travel contract in accordance with the cancellation clause above and the conditions provided herein while simultaneously placing a new booking. This shall however not apply in relation to booking change requests which incur only minor costs.

 

Travel Insurance

​

LuxeAway strongly recommends that you are covered by adequate travel insurance for your arrangements. Such insurance at a minimum should cover your losses sustained as a result of cancellation, trip interruption, medical issues, and repatriation in the event of accident or illness. Certain countries have a requirement for foreign visitors to have valid medical insurance on entry. LuxeAway cannot be held responsible for denied entry if a guest is unable to provide details to authorities of insurance or denial of entry for any reason. If you choose to travel without adequate insurance coverage, we will not be liable for any of your losses howsoever arising, which would have been covered had you purchased adequate insurance. LuxeAway can arrange relevant offers from insurers.

 

Travel Supplier Rules and Restrictions

​

LuxeAway is a travel planning, booking and consultation service that connects travelers to Travel Suppliers based on the traveler’s destination and needs. LuxeAway does not provide, own, or control any of the Travel Products, such as flights, accommodations, rental cars, packages, or travel insurance (the “Travel Products”). The Travel Products are owned, controlled or made available by third parties (the “Travel Suppliers). The Travel Suppliers are responsible for the Travel Products. The Travel Supplier’s terms and privacy policies apply to your booking so you must agree to and understand those terms. Furthermore, the terms of the actual Travel Supplier (airline, hotel, insurance, etc.) apply to your travel, so you must also agree to and understand those terms. Your interaction with any Travel Supplier accessed through the Website is at your own risk; LuxeAway does not bear any responsibility should anything go wrong with your booking or during your travel unless it solely was responsible for the event.

You acknowledge that some Travel Suppliers offering certain services and/or activities may require you to sign their liability waiver prior to participating in the service and/or activity they offer. You understand that any violation of any such Travel Supplier’s rules and restrictions may result in cancellation of your reservation(s), in your being denied access to the applicable Travel Product or services, in your forfeiting any monies paid for such reservation(s), and/or in our debiting your account for any costs we incur as a result of such violation. LuxeAway is not liable for any costs incurred due to hotel relocation.

 

International Travel

​

By offering reservations for travel in particular international destinations, LuxeAway does not represent or warrant that travel to such areas is advisable or without risk. LuxeAway will not be liable for damages or losses that result from travel to such destinations. It is your responsibility as a traveler that you read and adhere to published information and government reports about your destination.

​

You and any children traveling with you must be in possession of a machine-readable passport valid for 6 months after the trip return date along with all applicable visas. It is your sole responsibility to secure and/or pay for any and all visas, reciprocity fees, affidavits, immunizations, etc. that are required to be permitted entry into each destination, including stopovers. In some countries you may be subject to entry (reciprocity) fees and/or departure taxes/exit fees which will be collected at the airports upon entry/departure by local government authorities. Please note that entry to any country may be refused even if the required information and travel documents are complete.

For up-to-date detailed information on travel documents and visas, entry/exit taxes and further information on entry and exit requirements please check with your local consular services. Obtaining and carrying these documents is your sole responsibility. LuxeAway bears no responsibility for such information and will not be responsible for advising and/or obtaining required travel documentation for you, or for any delays, damages, and/or losses including missed portions of your vacation/holiday related to improper documentation or government decisions about entry.

Health: Recommended inoculations for travel may change. LuxeAway is not a medical advisor or medical expert, and cannot determine your health or fitness for travel. Before departure, you should consult your doctor so they can consider your medical history and expected destinations in order to provide you current recommendations. It is your responsibility to ensure that you meet all health entry requirements, obtain the recommended inoculations, take all recommended medication, and follow all medical advice in relation to your trip.

Liability Disclaimer

​

The carriers, hotels, and other Travel Suppliers providing travel or other services on this Website are independent contractors and not agents or employees of LuxeAway. LuxeAway is not liable for the acts, errors, omissions, representations, warranties, breaches or negligence of any such suppliers or for any personal injuries, death, property damage, or other damages or expenses resulting there from. LuxeAway has no liability and will make no refund in the event of any delay, cancellation, overbooking, strike, force majeure or other causes beyond LuxeAway’s direct control, and LuxeAways has no responsibility for any additional expenses, omissions, delays, re-routing or acts of any government or authority.

Indemnification

​

Subject to these Terms, you will defend, indemnify and hold LuxeAway and each of our officers, directors, employees and agents harmless from and against any claim, cause of action, liability, expense, loss or demand, including—without limitation—reasonable legal and accounting fees, arising out of, or in any way connected with your breach of these Terms or the agreements made part of these Terms by reference, your breach of any applicable law, and your use of or access to the Website, or Intellectual Property.

Entire Agreement; Severability

​

This agreement, including any other terms and conditions referenced herein, constitutes the entire agreement with respect to this Website and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, with respect to this Website. If any provision of these Terms shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.

Jurisdiction and applicable law

​

These Terms & Conditions and any agreement to which they apply are governed in all respects by the laws of the state of Florida without regard to conflicts of law principles. All guest claims must be submitted in writing and received by LuxeAway no later than sixty (60) days after the completion of the LuxeAway vacation. Guest claims not submitted and received within this time shall be deemed waived and barred.


General Travel Information

Complaints about lost or damaged baggage

​

If you discover that your baggage has been damaged or even lost after your flight, it is important that you report this immediately at the Lost and Found counter at your arrival airport. Request a written Property Irregularity Report or a Lost Report. Without these documents, the airline will not be liable for any damage or loss.

​

Check-in at the airport

​

Please arrive at the airline check-in desk at the airport at least two hours before your departure. As a rule, check-in counters open two to three hours before the flight departure. Passengers travelling in Business or First Class often check in at separate check-in desks. Please make sure that your luggage is checked through to the destination airport. If you are unsure, please advise the airport staff of your destination.

Flight Schedule

​

If you have booked your flights via LuxeAway, you will receive a list of your booked flights with the necessary travel documents. You will need these documents for the online check-in or at the check-in at the airport. A passport is often sufficient for the airport check-in desk. Sometimes, however, you will be asked about your flight schedule, which is why we ask you to always carry it with you and keep it for onward flights.

​

Luggage on your flights

​

We recommend that you do not carry any valuables or electronic devices (e.g. notebook, camera, etc.) in your checked baggage during the flight. No liability will be accepted for any damage or theft. Please always stow all valuables in your hand luggage. Please comply with the baggage regulations of the respective airline. Some airlines charge a high amount for excess baggage, which can be as high as 10 to 30 USD per additional pound of weight.

Online check-in

​

Most airlines now offer the option of online check-in. With this in mind, you can usually check in from home with your name and booking number between 48 and 24 hours before departure. Some airlines allow you to print out your boarding pass at home, or have it sent to your mobile phone. This saves you the time of checking-in at the airport. If this is the case, all you have to do on the day of departure is check in your baggage at the airline's baggage check-in counter.

Reconfirmation of long-haul flights

​

We recommend that you reconfirm your long-haul flights three days prior to departure, as flight times may sometimes change prior to your departure. You do not need to reconfirm the outbound flight. Your travel guide will be happy to reconfirm your flight home as well. For self-drive tours or other individually booked trips without a tour guide, we recommend that you check the flight times of your international return flight again before departure. The same also applies if you have not booked your flights via LuxeAway.

Delay or cancelation of flights

​

If your domestic flight within the US or to a transfer airport such as New York, Los Angeles, Chicago, or other city is delayed or canceled, please contact the airline staff at the check-in desk and inform LuxeAway concierge as soon as possible. This also applies to delays or cancelations of long-haul flights.

Safety and Security

​

LuxeAway knows emergencies can occur while traveling. In order to mitigate potential emergencies, we strongly recommend everyone has robust travel insurance. It’s also why we provide you specific local emergency lines as well as LuxeAway’s concierge phone line. You can find them in your pre-departure information. Store these in your phone, and carry them in your wallet at all times.

​

Besides local emergency lines, for any immediate emergency, please comply with local authorities. Given their proximity, local authorities are always the best resource for immediate response. If there is any connectivity issue, or any security concerns on your trip, please call the LuxeAway concierge number, which is available in your travel package.
